4. Use of the Service

Permitted Use

TryWith.ai grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service strictly for its intended purpose: generating AI-powered artwork, covers, and designs.

Prohibited Conduct

You agree NOT to:

• Use the Service to generate content that is illegal, harmful, abusive, defamatory, obscene, or infringing.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service's source code or AI models.
• Use automated scripts ("bots" or "scrapers") to access the Site without permission.
• Interfere with or disrupt the servers (e.g., AWS, Vercel) and networks connected to the Service.
• Use the Service to infringe upon the intellectual property rights of others.

5. User Content & AI Generations

Ownership

• Your Uploads: You retain ownership of any images or text prompts you upload to the Service ("User Inputs").
• Generated Assets: Subject to your compliance with these Terms, you own the rights to the content generated by the AI service based on your inputs ("Generated Content").

License to TryWith.ai

By using the Service, you grant TryWith.ai a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Inputs and Generated Content solely for the purpose of:

1. Providing the Service to you (e.g., processing images on our servers).
2. Improving our AI models and system performance (unless you have opted out via settings).

Content Restrictions

You agree strictly NOT to generate or upload content that:

• Depicts sexual abuse, child exploitation, or non-consensual sexual content.
• Promotes self-harm, suicide, or illegal acts.
• Contains hate speech or discrimination based on race, religion, gender, or sexual orientation.
• Infringes on third-party copyrights (e.g., uploading famous trademarked characters).
• Impersonation: Generates realistic images of public figures or private individuals without their consent.

Enforcement: We reserve the right to ban users who violate these content policies without refund.

6. Payment and Subscription

Fees and Billing

Certain features (e.g., high-resolution downloads, unlimited generations) require payment. We use third-party payment processors (e.g., Stripe) to handle transactions. By subscribing, you authorize us and our processor to charge your payment method for the applicable fees.

Cancellation

You can cancel your subscription at any time via your account settings (Billing page).

• Effect: After cancellation, your premium access will continue until the end of the current billing cycle.
• No Auto-Renewal: Once cancelled, you will not be charged for the next cycle.

Refunds

• Non-refundable: All fees paid are generally non-refundable.
• Exceptions: We may, at our sole discretion, offer refunds in cases of technical failure where the Service was unusable. Please contact support@trywith.ai for such requests.

7. Intellectual Property

All intellectual property rights in the Site's interface, code, logo, and brand ("TryWith.ai") are owned by us. You are not granted any rights to use our trademarks without prior written permission.

8. Disclaimers and Limitation of Liability

The Service utilizes Artificial Intelligence. You acknowledge that:

1. AI may produce artifacts, errors, or unexpected results.
2. The Service is provided "AS IS" without warranties of any kind regarding the quality or suitability of the generated images for your specific needs.

Limitation of Liability

To the maximum extent permitted by law, TryWith.ai (and its developers/affiliates) shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits) arising from your use of the Service.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice via email or website banner prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
